Photography Terms and Conditions Contract
Effective Date: 12/05/2024
This agreement is between Happily Ever After Lens (“Photographer”) and the client (“Client”) for the purpose of photography services.
1. Booking and Payments
• A deposit of 50% is required to secure your appointment.
• The remaining balance must be paid no later 48 hours before your appointment.
• Bookings are confirmed upon receipt of the deposit and signed contract.
2. Rescheduling and Cancellation
• Rescheduling: Clients may reschedule once with at least 72 hours notice. A rescheduling fee may apply.
• Cancellation: If the Client cancels, the deposit is non-refundable within 72 hours of the appointment.
3. Copyright and Usage
• The Photographer retains copyright to all images.
• Clients are granted a personal-use license for digital photos, allowing sharing and printing for personal purposes.
• Photos may not be edited, altered, or used for commercial purposes without permission.
4. Model Release
• By booking, the Client grants the Photographer permission to use photos for portfolios, social media, and marketing.
• If the Client does not agree, they must notify the Photographer in writing before the session.
5. Delivery of Photos
• Edited digital images will be delivered within 2 weeks through an online gallery.
• Print products and additional edits may take longer, depending on production times.
6. Liability
• The Photographer is not responsible for circumstances beyond their control (e.g., weather, emergencies, or uncooperative subjects).
• Liability is limited to the refund of paid fees if the Photographer fails to deliver services.
7. Safety
Happily Ever After Lens and the photographer shall not be liable for any injuries, damages, or losses suffered by the Client or any other person during the Photoshoot, regardless of whether such injuries, damages, or losses are caused by the Photographer's negligence or otherwise.
The Client assumes all risks associated with the Photoshoot, including but not limited to, risks associated with the location, weather conditions, and activities undertaken during the Photoshoot.
8. Agreement
By booking, the Client agrees to the terms outlined above. Both parties must sign to confirm the agreement.
